The 5-Year Structural Guarantee
Under Section 14(3) of the RERA Act, developers are legally bound to provide a 5-year warranty on your home. If any structural defects—such as major cracks, leakage, or foundation issues—appear within five years of possession, the builder is solely responsible for fixing them
The “30-Day Fix” Mandate
If you discover a defect and notify the builder, the law requires them to rectify it within 30 days. Most importantly, this repair must be done free of charge. The builder cannot ask you for a single rupee for these structural corrections.

Before you accept the keys, ensure you perform a “Snagging” audit:
- Structural Integrity: Inspect corners for deep cracks or uneven plaster.
- Dampness & Seepage: Check walls adjacent to bathrooms and kitchens for moisture.
- Hollow Flooring: Tap on floor tiles to ensure they are properly set and not hollow underneath
Legal Action Against Defaulting Builders
If the builder refuses to honor the 30-day repair window, you have the right to file a formal complaint with the RERA Authority. RERA has the power to penalize the developer and ensure you receive fair compensation for the mental agony and repair costs.
